Alfred Carlson Serves as Faculty for Travelers Insurance Seminar

Martin, Banks, Pond, Lehocky & Wilson attorney Alfred Carlson recently served as faculty for workers' compensation clients of Travelers Insurance Company. Mr. Carlson spoke about recent Pennsylvania workers' compensation law updates and hot issues in the field. The seminar was held at the Inn at Reading.

Jerry Lehocky Re-elected to Pennsylvania Trial Lawyers' Association Workers' Compensation Law Section Chair

Martin, Banks, Pond, Lehocky & Wilson attorney Jerry M. Lehocky has been elected as Chair of the Workers' Compensation Law Sectino of the Pennsylvania Trial Lawyers Association (PaTLA). The Workers' Compensation Law Section of PaTLA was established to address the needs of members that represent claimants in workers' compensation matters. They focus on the development and understanding of the law relating to workers' compensation law and how it affects claimants.

Martin, Banks, Pond, Lehocky & Wilson Attorneys Serve as Faculty for Pennsylvania Bar Association's Fall Section Meeting

George Martin, Managing Partner of Martin, Banks, Pond, Lehocky & Wilson served as faculty and Halmon Banks, served on the Advisory Panel for the 23rd Annual Pennsylvania Bar Assocation's Workers' Compensation Fall Section Meeting. Each year, workers' compensation attorneys and judges gather in Hershey, Pennsylvania for the Fall Section Meeting. The event offers the opportunity to explore the hottest issues in depth as well as to exchange ideas and experiences informally with colleagues from across the state. Mr. Martin served as faculty for the Recent Developments in Workers' Compensation Law program.

Commonwealth Court Restricts Employer's Right to Offsets Based on Old-Age Social Security Benefits

In Maxim Crane Works v. WCAB (Solano), the Commonwealth Court handed down an decision which greatly restricts an employer's right to take a credit to offset workers' compensation benefits based on an injured worker's receipt of old-age Social Security benefits.

Under the Pennsylvania Workers' Compensation Act, an employer is entitled to an offset against workers' compensation in certain situations for pension and retirement benefits as well as Social Security retirement benefits. Act 57 of 1996 provided for the creation of forms by the Bureau of Workers' Compensation for an injured worker to report his or her recript of such benefits as well as for the employer to notify the worker of its right to an offset. Specifically, the Bureau created the Employee Report of Benefits (LIBC-756) form and the Notice of Workers' Compensation Benefit Offset (LIBC-761) form.

Amit J. Shah Joins Martin, Banks, Pond, Lehocky & Wilson

Martin, Banks, Pond, Lehocky & Wilson has expanded its workers' compensation practice with the addition of Amit J. Shah as an Associate. Prior to joining the firm, Mr. Shah was an associate with a boutique defense firm, handling workers' compensation defense litigation in Pennsylvania. He brings more than three years of experience in workers' compensation to his position. Mr. Shah joins the firm to work exclusively on protecting the rights of injured workers in Pennsylvania.

In 2004, Mr. Shah earned his law degree from Dickinson School of Law of the Pennsylvania State University. During law school, he was a member of the Minority Law Student Association and served as a law clerk in a local solo practitioner's office. He received his bachelor of arts degree in administration of justice in 2001 from The Pennsylvania State University. Mr. Shah is admitted to practice in Pennsylvania and New Jersey and is a member of the Pennsylvania Bar Association's Workers' Compensation Division.
